ORDINANCE NO 12
AN ORDINANCE OF THE TOWNSHIP OF PINE, COUNTY OF INDIANA AND COMMONWEALTH OF PENNSYLVANIA, DIRECTING AND REQUIRING THE CONNEC¬TION OF CERTAIN BUILDINGS WITH THE PUBLIC WATER SYSTEM IN THE TOWNSHIP ON THE PREMISES ACCESSIBLE THERETO; PROVIDING FOR THE MEMETHOD OF CONNECTION BETWEEN BUILDINGS AND CERTAIN WATER LINES AND FOR THE INSPECTION THEREOF; PROVIDING FOR THE ISSUANCE PERMIT AND THE PAYMENT OF CHARGES THEREOF; AND PROVIDING PENALTIES FOR VIOLATIONS THEREOF.
BE IT ORDAINED AND ENACTED by the Board of Supervisors of the Township of Pine, and it is hereby ordained and enacted by the authority of the same and pursuant to the Act of April 22, 1970, P.L. 303, No. 97 (53 Purdon's Statute), as follows:
Section 1: Every owner of property in the Township of Pine whose property abuts upon any portion of the public water and supply distribution system to be acquired by the Indiana County Municipal Services Authority (herein called the "Authority") who is presently a customer of the Pine Township Water Company, must continue to leave the house, building or other structures on the said property which are connected to the aforementioned water system, connected to said system once it is acquired by the Authority (herein called the "Public Water System"). Every property owner of these aforementioned connections will be subject to the Rules, Regulations and Rates of the Authority.
Section 2: It shall be unlawful for any owner, lessee, or occupier of any property in the Township of Pine with an afore¬mentioned connection to employ any means of obtaining water for purposes of human consumption other than the aforementioned Public Water System.
Section 3: No person, firm or corporation which is now within the Pine Township Water Company water service system and upon which an existing structure is located which is not presently connected to said system shall be required to connect to the Public Water System under the terms and provisions of the Ordinance.
Section 4: The owner or owners of the aforementioned property of Section 1 shall permit the Authority's designated inspector full and complete access to all water system facilities in each building and in and about all parts of the property for the purpose of inspecting said facilities.
Section 5: Any service connection to the Public Water System of the aforementioned properties of Section 1 found to be deficient by the Authority's Inspector shall be replaced in accordance with the specifications, plans and procedures established by the Authority in its Rules and Regulations. Said replacement must be accomplished by the' property owner within ninety (90) days of receiving the Inspector's written report. Said property owners must give the Authority's Inspector at least twenty-four (24) hours notice of the time when such connection shall be made in order that the Inspector can be present to inspect and approve the work of connections. Said Inspector shall signify his approval in writing to the property owner. No water connection line shall be covered over, or in any way concealed, until after it has been inspected and approved by said Inspector.
Section 6: Any person, -firm or corporation in violation of the terms and provisions of this Ordinance shall, upon conviction thereof, before a Justice of the Peace, pay a fine or penalty of Three Hundred Dollars ($300.00), and upon default of payment thereof shall be sentenced to undergo a term of imprisonment of not less than five (5) days nor more than thirty (30) days in the County Jail.
Section 7: It is hereby declared as the legislative intent that the invalidity of any section, clause, sentence or provision of this Ordinance shall not affect the validity of any other par of this Ordinance which shall be given effect without such in¬valid part or parts.
Section 8: All ordinances or resolutions or parts of ordinances or resolutions not in accord with this Ordinance are hereby repealed insofar as they affect this Ordinance.
ORDAINED AND ENACTED into law by the Board of Supervisors of the Township of Pine in lawful session assembled this 2nd Day of July, 1982.
